President Droupadi Murmu Approves Landmark Telecommunications Act, 2023

In a historic move, President Droupadi Murmu has given her assent to the Telecommunications Act, 2023, marking a significant stride in the evolution of India’s telecommunications landscape. This Act, replacing the archaic Telegraph Act of 1885, underscores the government’s commitment to modernize and streamline the regulatory framework governing telecom services in the country.

The new legislation largely preserves the existing telecommunications laws while introducing crucial updates to accommodate the dynamic nature of the industry. One notable aspect is the formalization of practices, including the reservation of spectrum bands for various purposes and the implementation of robust dispute resolution mechanisms for conflicts between licensed service providers and the government.

Addressing concerns about potential overreach, the Act has sparked discussions among digital rights advocates due to the broad interpretation of the term ‘telecommunications.’ Notably, there is unease regarding whether online services such as email and messaging apps fall under this purview. In response to these concerns, Union Minister for Electronics and Information Technology, Ashwini Vaishnaw, clarified that the government does not intend to regulate online apps through this Act, reassuring stakeholders about the protection of digital freedoms.

The Act also introduces novel mechanisms for telecom operators to obtain permissions for setting up their equipment in different states, fostering a more efficient and streamlined process.

A pivotal aspect of the legislation resolves the long-debated question of whether spectrum for satellite Internet should be auctioned. Neeraj Mittal, Secretary of the Department of Telecommunications, emphasized that auctioning satellite Internet spectrum is impractical, as it utilizes high-frequency wavelengths, enabling multiple users without significant interference.

President Droupadi Murmu, in signing the Telecommunications Act, 2023, has paved the way for a more adaptive and forward-looking regulatory environment. The Act not only embraces technological advancements but also ensures the protection of individual liberties in the digital realm.
