Government Introduces Draft Rules to Regulate Coaching Centre Advertisements

In a bid to crack down on misleading advertisements by coaching institutions, the Central Consumer Protection Authority (CCPA) has unveiled draft guidelines aimed at curbing deceptive claims, including the promise of 100% selection or job guarantees. The guidelines, titled ‘Prevention of Misleading Advertisement in Coaching Sector,’ were released by the Ministry of Consumer Affairs, Food and Public Distribution.

Under these proposed regulations, coaching centers and individuals associated with them are prohibited from making false assertions such as guaranteeing 100% selection or job placement. The draft guidelines also emphasize transparency in advertising, requiring coaching centers to provide accurate information regarding course names, duration, and success rates, supported by verifiable evidence.

Furthermore, the guidelines restrict the use of testimonials or success stories in advertisements without the express consent of the individuals involved. Advertisements cannot lead consumers to believe that enrollment in a coaching center guarantees specific outcomes such as high marks, job placements, or admission to prestigious institutions.

The CCPA formed a panel in December 2023 to address concerns related to misleading advertisements in the coaching sector, followed by a stakeholder consultation in January 2024. The release of these draft guidelines marks a significant step towards promoting transparency and accountability in the coaching industry.

The Ministry of Consumer Affairs, Food and Public Distribution has invited public feedback on the draft guidelines, allowing stakeholders to share their views and suggestions within a 30-day period.
