TRAI Seeks Public Input on Review of Telecom Commercial Communications Regulations

The Telecom Regulatory Authority of India (TRAI) has issued a consultation paper inviting public comments on the “Review of the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR-2018).” These regulations, initially implemented in February 2019, were designed to address the issue of Unsolicited Commercial Communications (UCC) by protecting consumers from unwanted promotional calls and messages. They also aimed to allow businesses to send targeted communications to customers who had consented or set preferences to receive them.

However, during the implementation of these regulatory frameworks, certain issues have emerged, prompting TRAI to consider amendments. The consultation paper outlines several key issues that need immediate attention, including:

  • Definitions of Commercial Communications.
  • Provisions related to Complaint Redressal.
  • UCC Detection Systems and associated actions.
  • Financial Disincentives for violations.
  • Provisions for Senders and Telemarketers.
  • Analysis of the high volume of voice calls and SMS.

TRAI is particularly seeking input on strengthening regulations to address harassment from Unregistered Telemarketers (UTMs) through spam calls, improving complaint redressal mechanisms, enhancing UCC detection systems, and implementing stronger financial penalties for regulatory violations. The possibility of introducing differential tariffs for voice calls and SMS to discourage UCC is also being explored.

The consultation paper is available on the TRAI website, and written comments from stakeholders are invited by September 25, 2024, with counter-comments due by October 9, 2024. Interested parties can submit their comments electronically to advqos@trai.gov.in.
